Official letter so 03/BHXH-QLT dated 04/01/2021 of Social Security Office of Ho Chi Minh City regard to foreign currency rate exchange for first 6 months of 2021

This rate exchange will be applied from 04/01/2021 to the end of first 6 months of 2021

This rate exchange was determined by average interbank rate exchange released by State Bank of Vietnam at notification no 01/TB-NHNN dated 04/01/2021

Enterprises should also note that signing labor contracts in foreign currency only accepts foreign workers (Clause 14, Article 4 of Circular No. 32/2013 / TT-NHNN).

Hai Phong City Tax Department provides guidelines in principle as follows:
In case the Company hires foreign workers to perform jobs in Vietnam, in cases where a work permit is required but has not been granted a work permit by a competent authority in Vietnam in accordance with the Labor Code, the expenses paid by the Company to the employee before the time the work permit is issued and before the time the two parties sign the labor contract will not be included in the deductible expenses when determining CIT income.
