Circular No 10/2020/TT-BLDTBXH date 12/11/2020 of Minister of Labor, War Invalids and Social Affairs stating details and guiding the implementation of a number of articles of the Law on Labor regard to content of labor contract, Collective bargaining council and occupation and job adversely affect reproductive function and child rearing
Accordingly, since 01/01/2021, all information as below are obligated stated on labor contract:
– Telephone number of employee
– Number of work permit or number of confirmation letter employee belongs to work permit exemption case ( incased employee is foreigner)
– Working place: stated fully places where employee works regularly
– Salary: stated clearly time based salary of works ( hereby timing salary). Including the case of a flat salary or a product salary, the time based salary must be indicated;
– Salary payment term: according to Article 97 of the Law on Labor No. 45/2019 / QH14, that means a specific period must be fixed and cyclical
The Circular is attached with the Appendix on the List of occupations and jobs that adversely affect reproductive functions and child rearing. Accordingly, enterprises must disclose these occupations with information about their harm so that female employees can choose whether to continue signing or not signing labor contracts. Male workers also have a number of occupations that are declared “adversely affecting reproductive function”.
This Circular takes effect from 01/01/2021
